Terms of Service

1. Introduction

Welcome to Give PreCheck ("Service"), operated by Give PreCheck, LLC, a Delaware limited liability company ("Company," "we," "us," or "our"). By accessing or using GivePrecheck.com (the "Site") or purchasing or receiving any aspect of our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of the Service

Give PreCheck is a managed enrollment assistance service. When a buyer purchases the Service on behalf of a recipient, we provide two things: (a) a prepaid payment instrument loaded with sufficient funds to cover the TSA PreCheck enrollment fee at an approved enrollment center, and (b) an AI-powered SMS-based enrollment assistant ("PreCheck CoPilot") that guides the recipient through the enrollment process, including selecting an enrollment center, booking an appointment, and preparing for their visit. Give PreCheck is not a gift card, stored-value product, or money transmission service. It is a managed concierge service designed to facilitate TSA PreCheck enrollment.

3. Eligibility

You must be at least 18 years of age to purchase the Service. There are no citizenship or residency requirements to purchase the Service, but the recipient must be eligible for TSA PreCheck enrollment and must complete the enrollment process in person at a participating enrollment center located in the United States.

4. How the Service Works

4.1 Purchase The buyer provides recipient information (name, phone number) and an optional gift message during checkout. Payment is processed securely via Stripe. The purchase price covers the enrollment fee and our service fee. 4.2 Recipient Enrollment Assistance After purchase, the recipient will receive SMS messages from PreCheck CoPilot, our AI-powered enrollment assistant. The assistant will help the recipient select an enrollment center, book an appointment, and prepare for their in-person visit. 4.3 Payment Card After the recipient confirms their enrollment appointment, we provide a payment card (virtual or physical, at the recipient's choice) pre-loaded with the enrollment fee. This card is to be used exclusively to pay the enrollment fee at the recipient's chosen enrollment center. 4.4 TSA PreCheck Enrollment The recipient must complete enrollment in person at an approved enrollment center (currently IDEMIA/IdentoGO or Telos). TSA PreCheck approval is determined solely by the Transportation Security Administration. We do not guarantee approval.

5. AI-Powered Assistant Disclosure

PreCheck CoPilot is an AI-powered assistant, not a human. While we strive for accuracy, the assistant may occasionally provide imperfect guidance. A human support team is available and may take over the conversation at any point. If the assistant is unable to help, a human team member will follow up.

6. Refund Policy

Refund requests are evaluated on a case-by-case basis. To request a refund, contact us at admin@giveprecheck.com. Factors we consider include whether the payment card has been redeemed, whether the recipient has completed enrollment, and the time elapsed since purchase. We reserve the right to deny refund requests at our discretion. For full details, see our Refund Policy.

7. Acceptable Use

You agree not to: • Use the Service for any unlawful purpose • Provide false or misleading information during purchase • Attempt to redeem or use the payment card for any purpose other than TSA PreCheck enrollment fees • Interfere with or disrupt the Service or its infrastructure • Harass, abuse, or send harmful content to the AI assistant or human support staff • Resell, redistribute, or commercially exploit the Service

8. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of Give PreCheck, LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

9. Third-Party Services

The Service relies on third-party providers for payment processing (Stripe), SMS delivery (Twilio), and card issuance. We are not responsible for the availability, performance, or policies of these third-party services. TSA PreCheck enrollment is administered by the Transportation Security Administration and its authorized enrollment providers. We are not affiliated with, endorsed by, or partnered with the TSA, DHS, IDEMIA, or Telos.

10. What We Promise

We will make commercially reasonable efforts to deliver the Service as described, including issuing a valid payment card and providing enrollment guidance via our AI assistant. If something goes wrong on our end—for example, if we fail to deliver a payment card after your purchase—we will work to fix it or provide a refund.

11. What We Cannot Promise

There are things outside our control, and we want to be upfront about them: • TSA PreCheck approval is entirely up to the TSA. We help with the enrollment process, but we cannot guarantee the outcome. • Our AI assistant is helpful but imperfect. It may occasionally give incomplete or inaccurate guidance. A human team is available as a backstop. • We depend on third-party services (Stripe, Twilio, Tremendous) to operate. We cannot guarantee their uptime or performance. • Enrollment center availability, hours, and procedures are controlled by IDEMIA and Telos, not by us. EXCEPT FOR THE EXPRESS COMMITMENTS IN SECTION 10, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

We stand behind our Service, but our financial exposure needs to be proportionate to what you paid: TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIVE PRECHECK, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM. This limitation applies regardless of whether the claim is based in contract, tort, negligence, strict liability, or any other legal theory. Some jurisdictions do not allow the exclusion of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Give PreCheck, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Service in violation of these Terms, (b) your provision of false or misleading information, or (c) your violation of any rights of a third party.

14. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT. 14.1 Informal Resolution First Before initiating any formal proceeding, you agree to contact us at admin@giveprecheck.com and describe the dispute. We will try to resolve it informally within 30 days. 14.2 Binding Arbitration If we cannot resolve a dispute informally within 30 days, either party may initiate binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will be conducted by a single arbitrator in Wilmington, Delaware, or remotely. 14.3 Costs If you initiate arbitration, we will reimburse your filing fee if the arbitrator finds in your favor. 14.4 Confidentiality All arbitration proceedings shall be kept confidential by both parties, except as required by law. 14.5 Class Action Waiver YOU AND GIVE PRECHECK, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. 14.6 Exceptions Either party may bring a claim in small claims court or seek injunctive relief for intellectual property matters. 14.7 Opt-Out You may opt out of this arbitration provision by sending written notice to admin@giveprecheck.com within 30 days of first accepting these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.

16. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the effective date at the top of this page.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, SMS Consent Disclosure, Cookie Policy, Refund Policy, and AI Disclosure, constitute the entire agreement between you and Give PreCheck, LLC regarding the Service.
